The National Telecommunications and Information Administration’s Broadband Equity, Access, and Deployment (BEAD) Program adheres to the Build America Buy America Act (BABA), enacted as part of the Infrastructure Investment and Jobs Act on November 15, 2021. Recognizing the challenges of meeting the Act’s requirements and executing the mission of BEAD within its budgets, the NTIA sought a limited, time-constrained waiver for specific components of typical broadband networks.
The Department of Commerce’s Office of Acquisition Management published the waiver after public comment. The waiver is a limited, five-year, general applicability, nonavailability waiver of the Buy America Preference requirements for certain construction materials and certain manufactured products for the BEAD Program, effective on purchases from February 22, 2024, through February 22, 2029.
Cambium Networks fixed wireless broadband access (FWBA) and cnMatrix switching products, including the complete PMP 450, ePMP, EVO, cnWave 60 GHz, cnReach, and PTP 8xx product lines, are exempt from BEAD’s Build America Buy America (BABA) requirements as defined by Section III, Part 2, paragraph a, (Page 13) of the Department of Commerce’s waiver:
“DOC waives the Buy America Preference for all electronics in BEAD Program projects, with the exception of the four categories of electronics identified in this section: 1) Optical line terminals and remote optical line terminals, 2) OLT line cards, 3) optic pluggables, and 4) Standalone optical network terminals and optical network units.”
The BABA waiver of Cambium Network’s fixed wireless broadband access products and cnMatrix switching solutions shall apply to purchases made from February 22, 2024, through February 22, 2029.
